TERMS AND CONDITIONS

By accessing or using this website or enrolling in services offered through the Village website you acknowledge and agree to the following Terms and Conditions.

  1. WEBSITE USE

The Village maintains this website to provide residents, property owners, utility customers, businesses, and members of the public with information concerning Village government, programs, services, operations, and public notices. The Village attempts to provide accurate and current information but does not warrant that all information available through the website is complete, current, or free from error. Official Village records, ordinances, resolutions, and other documents maintained by the Village control over information presented on this website in the event of an inconsistency. Nothing on this website constitutes legal advice or creates any contractual or other legal right against the Village unless expressly provided by law or by a written agreement duly authorized by the Village.

  1. TEXT-MESSAGE NOTIFICATION SERVICE

The Village may offer residents, utility customers, and other members of the public the opportunity to receive SMS/text-message notifications. By providing a mobile telephone number and opting in to receive text messages from the Village, you consent to receive SMS/text messages relating to Village services and operations. Messages may include, as applicable:

  • boil-water and other water-system advisories;
  • water-main breaks and service interruptions;
  • utility account and service notifications;
  • shutoff or payment-related notices;
  • construction and infrastructure notices;
  • public-service announcements;
  • emergency or time-sensitive community information; and
  • other Village customer-service or informational communications.

Message frequency may vary. Message and data rates may apply depending upon your wireless carrier and service plan. Participation in the Village’s SMS/text-message notification program is voluntary. Consent to receive text messages is not a condition of receiving Village utility or other governmental services. By enrolling, you represent that you are the owner or authorized user of the mobile telephone number provided and are authorized to enroll that number in the Village’s notification program. You are responsible for notifying the Village if you discontinue use of or are no longer authorized to use the enrolled telephone number.

You may opt out of the Village’s SMS/text-message notification program at any time by replying STOP to a Village text message. After opting out, you may receive a message confirming your opt-out request. You will no longer receive messages through the applicable SMS program unless you subsequently opt in again. For assistance, reply HELP to a Village text message or contact the Village. Opting out of SMS/text messages does not prevent the Village from communicating with you through other methods when necessary or permitted by law.

The Village does not guarantee that any SMS/text message will be received or delivered within a particular period of time. Delivery may depend upon your wireless carrier, wireless-service availability, telecommunications networks, the Village’s service providers, and other circumstances outside the Village’s control. The SMS/text-message notification program is provided as a supplemental public-information service and should not be relied upon as the sole means of receiving emergency, public-safety, utility, or other time-sensitive information. In an emergency, call 911 when appropriate.

The Village is not responsible for delayed, undelivered, incomplete, or misdirected messages; interruptions or failures involving a wireless carrier or third-party service provider;  charges imposed by a wireless carrier; inability to access or use the notification service; or consequences resulting from reliance upon a text message that is delayed, incomplete, or not delivered.

Nothing in this section limits any right or remedy that cannot lawfully be limited under applicable law.

  1. THIRD-PARTY SERVICES AND LINKS

The Village may use third-party service providers to operate portions of its website or electronic communication services. The Village’s SMS/text-message notification program may be facilitated through the Village’s utility billing, telecommunications, and messaging providers. The Village may provide information to such service providers when reasonably necessary for them to perform services on the Village’s behalf, subject to applicable law and contractual requirements. The website may also contain links to websites or services operated by third parties. A link does not constitute the Village’s endorsement of the content, products, services, security, accessibility, or privacy practices of the third-party website or service. The Village is not responsible for the content, operation, availability, or practices of independently operated third-party websites.

  1. OHIO PUBLIC RECORDS

The Village is a public office subject to the Ohio Public Records Act, including Ohio Revised Code Section 149.43. Information submitted to or maintained by the Village through this website or the Village’s electronic communication services may constitute a public record and may be subject to inspection and disclosure unless exempt from disclosure under applicable federal or state law. Users should use appropriate care when submitting confidential, sensitive, or personally identifying information electronically.

Nothing in these Terms and Conditions designates information as public or confidential when its status is otherwise established by law; creates a promise that information submitted to the Village will remain confidential; expands or restricts the availability of any public record; or alters the Village’s obligations under applicable public-records, confidentiality, or records-retention laws.

  1. RECORDS RETENTION

Records created, received, or maintained through the Village website or electronic communication services will be maintained and disposed of in accordance with applicable law and the Village’s approved records-retention schedules. These Terms and Conditions do not create a right to require the Village to retain or delete information outside the requirements of applicable law and the Village’s records-retention schedules.

  1. WEBSITE AND SERVICE AVAILABILITY

The Village may modify, suspend, discontinue, restrict, or update portions of its website or electronic notification services at any time. The Village does not warrant that its website or notification services will be continuously available, uninterrupted, secure, or free from technical errors, viruses, or other harmful components. The Village is not responsible for interruptions or delays caused by telecommunications providers, internet service providers, third-party systems, equipment failures, system maintenance, cybersecurity incidents, or other circumstances outside the Village’s reasonable control.

  1. ACCEPTABLE USE

Users shall not use the Village’s website or electronic communication services to engage in unlawful, fraudulent, or unauthorized activity; interfere with the operation or security of the website or its associated systems; attempt to gain unauthorized access to any Village system, account, data, or network; transmit malicious code or other harmful material; impersonate another person or misrepresent the user’s affiliation or authorization; or use information obtained through the website in violation of applicable law.

The Village may restrict access to the website or its electronic services when reasonably necessary to protect Village systems, data, operations, or users.

  1. PRIVACY

Information collected through the Village website and SMS/text-message notification program will be handled as described in the Village’s Privacy Policy.

Nothing in the Privacy Policy or these Terms and Conditions creates a promise of confidentiality or restricts a disclosure required by the Ohio Public Records Act, court order, subpoena, or other applicable law.

  1. CHANGES TO THESE TERMS

The Village may revise these Terms and Conditions from time to time. Revised Terms and Conditions will be posted on the Village website. Continued use of the website or applicable electronic services after revised terms are posted constitutes acknowledgment of the revised terms, except where additional consent is required by applicable law.

  1. GOVERNING LAW

These Terms and Conditions are governed by applicable federal law and the laws of the State of Ohio. Nothing in these Terms and Conditions constitutes a waiver of any governmental, statutory, common-law, or other immunity, defense, limitation, or protection available to the Village or its officials, employees, representatives, or agents.
